2024 UPDATES/CHANGES:

SCRATCH DATE JAIL – Horses that scratch or are scratched will have a scratch date for
period of three entry days starting the day after the scratch. The horse(s) then will be
given a new date corresponding to the fourth entry day after scratching, automatically.
The horse(s) may enter during this time, depending on the scratch reason, but will keep
the (S) date unless getting back in, re-enter but are excluded or the fourth day
whichever is first.
DELAWARE CERTIFIED OR BRED – Maiden Delaware Bred or Certified Horses may enter
for the waiver *TWO TIMES* in all Maiden Claiming events of $25,000 and up.

PREFERENCE DATES
Delaware Bred or Certified Horses have preference in all races providing they meet
condition eligibility requirements. (Stake Races Excluded)
The Preference Dates are GOOD FOR ANY DISTANCE & SURFACE.
Preference dates will not supersede conditions of a race. Horses will not be eligible to
receive a Zero (0) date until their papers and/or digital papers are on file in the racing
office or have been scanned. All horses registered prior to NOON, Wednesday, May 8th,
will receive a zero (0), which is the lowest possible date. All horses registering after
NOON on Wednesday, May 8th, will receive a one (1) or preference corresponding to the
day of the meeting when registered. A zero (0) has first preference. Horses entering for
the first time but not getting in a race that fills or any book race 1-8 not carded, (i.e.
placed on the A.E., did not go or are excluded), will receive an entry date corresponding
to the date of which they entered for.
Horses which have established a date at the current meeting will lose their preference
should they race elsewhere and must reestablish a preference date at this meeting.
Horses that enter to run, have the opportunity to run or run will receive a preference
corresponding to the date they race and lose all dates previously held, (i.e. R1 would
correspond to a horse running on the first day of the meet.).
This excludes stakes and handicaps. If a race scheduled on the turf is transferred to the
dirt all starters will receive a (*) date, the (*) date is most preferred. The (*) date is
good for the next entry made at Delaware Park. If horse races elsewhere the (*) date is
lost.
Horses which scratch or are scratched will receive an (S) date upon which date they

AND/OR STABLED ON GROUNDS.
An up to date preference list will be made available after the overnight list is out. Any
omissions, discrepancies, errors etc. must be lodged prior to the next drawing of entries.
All horses placed on the Stewards, Veterinarian or Starter lists will be available in the
racing office. They will not be permitted to enter until they have been approved to
start. In no way does the claiming, ownership transfer or trainer transfer of a horse
affect the preference date. When a horse’s name appears in a race, other than a stake,
and is entered for the following day, such entry will be given no consideration should
the race in which it is entered be overfilled. It is the responsibility of a person making an
entry to claim preference at time of entry. The stewards will consider no claims that do
not comply with above regulations.

ASSOCIATION SCRATCH POLICY
The following rules are crucial to reassure that the Delaware Park, Purse Accounts and
the racing fans are given a chance to wager on an acceptable amount of betting
interests. We ask for your teamwork for the benefit of all parties involved.
There will be no exceptions to these rules.

Scratch time is prior to 10:00 A.M. the day of the race. Scratches will be made from

off the program.

Any Owner, Trainer or other duly authorized person wishing to scratch out of an
engagement to race must do so prior to 10:00 a.m. the day of the race, Stake races
exempt. The scratching of a horse out of an engagement for a race is irrevocable. The
Stewards must approve all scratches. In a race other than a Stake, no horse shall be
permitted to scratch if the number of betting interests remaining in the race number
less than eight (8), unless the Stewards permit a lesser number. Where there are more
requests to scratch, that if granted, would leave a field of less than eight (8) betting
interests, the Stewards shall determine which entrants may be scratched and permitted
to withdraw from the race.
Any horse appearing on the alternate list and is re-entered will be an automatic scratch
off the alternate list providing the race fills and the horse draws in the body of the race.
For any and all VET scratches, horses will be placed on the Veterinarian List for nine (9)
days starting the day after the race. Horses will not be permitted to race during that
time.
Any horse appearing in the body of a race must receive permission from the Racing
Secretary to re-enter and will be an automatic scratch the previous day of entries
providing the race fills and the horse draws in the body of the race. (Stake races
excluded).
Per Rule 11.14.1.5 – The Stewards will review all cases in which a horse is entered to run
at a licensed track in Delaware, while appearing in the entries in another racing
jurisdiction, during the five-day entry period for Delaware. It shall be a violation of
these Rules for a licensee to scratch a horse entered to race in Delaware in order for
said horse to race in another jurisdiction within the five-day entry period. Violations of
this Rule absent of mitigating circumstances, will be subject to fines of not less than
$1,000 and no more than $2,500. This rule shall not pertain to Handicap and Stake
races.
Trainers have until 45 minutes prior to post for Stake races to scratch their horse
without reason.

Entries:
May close by 10:30 am or when deemed appropriate by the Racing Secretary. Owners
and Trainers, when entering horses in races, are cautioned to check carefully as to the
eligibility of horses in their care and allowances claimed in races. Under the universal
rules of racing, an Owner or Trainer is responsible for the weight his horse carries. The
Racing Secretary will be glad to give the horsemen any information in respect to their
horses that is desired, but the final responsibility rests with the Owners and Trainers.
Hunt Meet races are not considered in either eligibility or weight allowances. The right
is reserved to change or withdraw any unclosed race.
All Filled and Overfilled Races will close fifteen (15) minutes after a final is
announced.
Bonuses / 2024: Bonuses will be awarded to the owners of horses which start in a race
and finish out of the money. That Bonus will be $150.
Coupled Entries: In any race of which two same owner entries are made, they will
automatically be uncoupled. Maximum of two entries (same or different owner) per
trainer a race (excluding stakes). In an overfilled race a same owner entry cannot
exclude any other entry
Delaware Bred or Certified Horses:
Receive preference in Races providing they meet condition eligibility requirements.
(Excluding Stakes)
Maiden Delaware Bred or Certified Horses may enter for the waiver *TWO TIMES* in all
Maiden Claiming events of $25,000 and up.
Division of Purses: All purses will be divided up as follows: 60% to the Winner, 20% to
Second, 11% to Third, 6% to Fourth and 3% to Fifth.
Eligibility:
The following horses will not be eligible to STABLE or RACE at Delaware Park:
1. Horses which have started eight (8) or more times consecutively without
finishing 1st, 2nd, 3rd, 4th or 5th. Allowance, Stake and Handicap races are
exempt.
2. Maidens Eight (8) years of age or older and horses over twelve (12) years of
age will not be eligible for stall space or permitted to start.
3. Without Proof or Confirmation of Worker’s Compensation and General
Liability.

Equipment Changes – All equipment changes must be made at time of entry. Any late
changes must be approved by the Stewards. Blinker changes off a win can only be
approved by the Stewards. The use of nasal strips is permitted.
Horsemen’s Bookkeeper ( ext. 7262 – Email –hb@delawarepark.com or horsemensbookkeeper@delawarepark.com) –
The Office is open until after the last race on racing days to transact business with horse
Owners, Trainers, and Jockeys. The office will be closed on Sundays & Mondays (unless
a race day). In order to transact business efficiently, Owners, Trainers and Jockeys need
to be sure the Bookkeeper has accurate information on names, addresses and tax
identification numbers. If your address has changed since being licensed, please notify
the Bookkeeper. Internal Revenue Service regulations require current names and tax
identification numbers (Social Security numbers) to be on file. In accordance with
Delaware State Income Tax Law, all Owners, Trainers and Riders are required to file
income tax returns with the State of Delaware for any monies earned within the State.

Horsemen’s Checks – Internal Revenue Service regulations require submission of signed
W-8 or W-9 forms with Federal ID number or Social Security number in order for checks
to be issued. Failure to file these forms will require 31% withholding of all funds. Please
contact the Horsemen’s Bookkeeper for further information.

Naming a Rider: All Trainers must secure a call with a jockey’s agent prior to making an
entry. It is the trainer’s responsibility, at the time of entry, to list all backup riders
including an apprentice if a call has not been secured prior to entry. Apprentice rider(s)
can be named at the draw if not named as a backup.

150 Day Layoff Report – Trainers must complete the 150-Day Layoff form for all
horse(s), that have not raced for 150 days or more. The form shall be submitted to the
Head State Veterinarian prior to entry. The form shall be submitted 30 days before
entry and is valid for 60 days from the date of submission. The form is available in the
State Veterinarians office, Racing Office or Delaware Parks website in the horsemen
area.
SALIX (Furosemide/Lasix) NOTICE – The ONLY permissible medication at Delaware Park
will be SALIX, and ONLY can be administered by the appointed Delaware State
Veterinarian.

Amicar is not permitted at Delaware Park.
Salix (Furosemide/Lasix) – A horse that bled for the first time shall not be permitted to
run for a period of fourteen (14) calendar days beginning the following calendar day. A
horse, which bleeds a second time, shall not be permitted to run for thirty (30) calendar
days. A horse, which bleeds a third time, will not be permitted to run for ninety (90)
calendar days. A horse, which bleeds a fourth time within a calendar year of the first
bleeding incident, shall be barred from further racing in the state of Delaware. If a
horse’s fourth bleeding incident occurs more than one (1) year after the first bleeding
incident, the horse shall not be barred, but shall not be permitted to run for one (1)
calendar year. A positive endoscopic examination may be classified as a first-time
bleeder.
DTRC Bleeder Declaration – A horse which has been certified OR DECLARED as a
bleeder in another jurisdiction may be placed on the bleeder list provided that the other
jurisdiction qualified it as a bleeder using criteria satisfactory to the Commission’s
Veterinarian and the Stewards. It shall be the absolute responsibility of the Trainer to
report bleeders from other jurisdictions to the Commission Veterinarian or Stewards on
official forms from that State prior to entry.

Instructions for Bleeder Certification
1. All certificates must be turned into the Salix/Lasix office within 24 hours.
Certificates will not be accepted after that time.
2. Certificate may not be distributed to Trainer until a State Veterinarian has
signed it.
3. Veterinarians must obtain the foal papers of the horse (or a copy of them) in
order to verify the correct name and tattoo.
4. Horses must be; tattooed and/or digitally tattooed with a microchip and
named before being scoped for bleeder certification. No name, no tattoo, no
scope!!
5. All information on certificate must be printed legibly.
6. Veterinarians must sign the certificate and then print their name.
7. Please print Trainer’s or Assistant Trainer’s name on certificate.
SHOE RULE
(a)Except for full rims 2 mm or less from the ground surface of the Horseshoe,
traction devices are prohibited on forelimb and hindlimb Horseshoes during
racing and training on dirt or synthetic racing tracks.
(b) Traction devices are prohibited on forelimb and hindlimb Horseshoes during
training and racing on the turf.
(c) Traction devices include but are not limited to rims, toe grabs, bends, jar
caulks and stickers.
ENFORCEMENT OF HISA RULE 2276 (HORSESHOES)
Rule 2276 shall be enforced for horses racing on dirt surfaces that are shod on the
hindlimbs with traction devices in the form of either a full outer rim shoe (up to 4mm
in height) or a toe grab (up to 4mm in height). All other provisions of Rule 2276 shall
remain in full force and effect.
Starters Fee – All starters will pay a $20.00 fee in lieu of any pony fees. These fees paid
to the Association shall be for the account of the Delaware Horsemen’s Assistance Fund,
to be used exclusively by it to assist needy persons connected with Delaware Racing.
Workouts – Any horse not starting in the last sixty (60) days must have one (1) Official
work before being allowed to start. First Time Starters, must have two (2) Official works
(and be okayed from the gate) before being allowed to start. All horses entering the
track for training shall be identified by name (if unnamed by breeding), type of workout,
distance and name of Trainer. Failure to report this information to the clocker @ ext.
7242 will be referred to the Stewards.
Work & Go – Must be pre-approved by the Director of Racing and/or the Racing
Secretary prior to arrival.

Turf Races
In turf races the maximum field size allowed will be drawn. Main Track Only
(MTO) Horses will be drawn into the body of the race but is considered an
alternate.

Any horse(s) that are Main Track Only (MTO’s) in the Program/Racing Form
Must Contact the STEWARDS by 9:30 AM day of race otherwise will be
scratched by the STEWARDS & will be subject to a fine(s). Anyone who
desires to remain in the race as an MTO will be allowed to remain in the race
until the START of the previous race, at which time if the race remains on the
turf the horse will be scratched. All horses on Lasix must be treated at the
designated time to remain in the body of the race.
A ten-pound apprentice rider will not be allowed to ride on the Turf Course.
By order of the Stewards
Turf races (about distances) where the field is carded with 9, 10 or 11 horses,
if taken off the turf, numbers 10 through 12 will automatically be placed in
the Field. (Except races carded at One Mile where the Field will be limited to
10.)
Delaware Park reserves the right to transfer any scheduled turf race to the main
course because of track condition. In the event a race must be transferred from the
turf to the main course, the following distances will be used:

CLAIMING RULES
13.1.1 – In Claiming races, any horse, unless declared ineligible under Rule 13.20, is
subject to claim for its entered price by any Owner in good standing.
13.12.3 – A claim shall be voided if a horse is starter as determined by the commission,
and the horse:
13.12.3.1-Dies on the racetrack;
13.12.3.2-Suffers an injury which requires euthanasia of the horse
determined by the Commission Veterinarian while the horse is still on the racetrack;
13.12.3.3-Is vanned off the racetrack at the direction of the Commission
Veterinarian; or
13.12.3.4-Is observed by the Commission Veterinarian to be lame or unsound
while still on the racetrack and as such the Commission Veterinarian places that horse
on the Vets List.
13.1.3 – A new Owner, i.e., an individual, partnership, corporation or any other
authorized racing interest who has not held an Owner’s license from the Commission or
a previously licensed owner that has no current ownership is eligible to claim by
obtaining an “Open Claiming License” from the Commission.
13.18 – Caveat Emptor: Notwithstanding any designation of sex or age appearing on the
racing program or in any racing publication, the claimant of a horse shall be solely
responsible for determining the age or sex of the horse claimed.
13.6.1 – No horse claimed in a Claiming race shall be sold or transferred, wholly or in
part, to anyone within (30) days after the day it was claimed, except in another claiming
race. A horse claimed by an Owner that has started a horse at the current meet and by
a Trainer that is currently stabled on the grounds of the Association, shall not be
permitted to run in another racing jurisdiction for the period of sixty (60) days,
beginning the day after the claim was made, or until the end of the current meet,
whichever comes first. A horse that is claimed by an Owner that has started a horse at
the current meet, by a Trainer that is not currently stabled on the grounds of the
Association, shall not be permitted to race elsewhere until the close of the meeting
which it was claimed. The Stewards shall have authority to waive Rule under
application, so as to allow a claimed horse to race in a Stakes race. The Stewards may
also permit a horse claimed in a Steeplechase or Hurdle race, to race elsewhere in a –
Steeplechase program, if such a Program ends before the close of the meeting at which
it was claimed.
13.20.1 (Waiver Claim) – At the time of entry into a claiming race, the owner may opt to
declare a horse ineligible to be claimed provided that the horse has been laid-off and
has not started for a minimum of 120 days since its last race and is entered for a
claiming price equal to or greater than the claiming price of the horses last start. All
horses that elect to enter for the waiver and win, that win will be considered a claiming
win at the entered level for Delaware Park race conditions eligibility. Please contact all
surrounding racing jurisdictions to clarify their eligibility pertaining to this condition.

Who May Make a Claim?
A. In claiming races, any horse may be claimed for its entered price by any
Managing Owner (or his duly Authorized Agent) if the Managing Owner is
presently registered in good faith and has started a horse, up to or including
the race in which the claim is made. Such claim may be for the account only
of the Managing Owner making the claim, or for the ownership of the horse
which establishes such Managing Owner’s right to claim, as indicated by the
Managing Owner making the claim, as indicated by the Managing Owner on
the claim blank. However, no person shall claim his own horse or cause his
own horse to be claimed directly or indirectly for his own account.
B. Where the Managing Owner is a partnership, only such partnership through
its Managing Partner or such Managing Partner’s duly Authorized Agent may
claim.
C. A new Owner, i.e., an Individual Partnership, Corporation or any other
authorized racing interest who are in good standing and currently licensed in
Delaware are eligible to claim.
Conditions for Starting a Claimed Horse – If a horse is claimed it shall not start in a
claiming race for a period of twenty (20) days from the day after the claim for less than
twenty-five (25) percent more than the amount of which it was claimed. The day
claimed shall not count, the following calendar day shall be the first day and the horse
shall be entitled to enter whenever necessary so that it may start on the twenty-first
(21) calendar day following the claim at any price. This provision shall not apply to
starter handicaps, allowances, and starter allowance races.
Requirement for Claim: Determination by Stewards – All claims shall be in writing,
sealed and deposited in a locked box provided for this purpose by the clerk of the
course, at least ten (10) minutes before post time. No money shall accompany the
claim. Each person desiring to make a claim, unless he shall have such amount to his
credit with the association, must first deposit with the association the whole amount of
the claim in cash, for which a receipt will be given. All claims shall be passed upon by
the Stewards and the person determined at the claiming time for claiming to have the
right of claim shall become the Owner of the horse when the start is affected, whether it
be alive or dead, sound or unsound or injured during the race or after it, unless the age
of such horse has been misrepresented, and subject to the provisions of subdivision (b)
of this section. If more than one person should enter a claim for the same horse, the
disposition of the horse shall be decided by lot by the Stewards. An Owner shall not be
informed that a claim has been made until after the race has been run, and any horse so
claimed shall be delivered to the Claimant. Both the claim form and envelope must be
filled out completely and must be accurate in every detail. A post-race test may be
taken from any horse claimed out of a claiming race. The Trainer of the horse at the
time of the entry for the race from which the horse was claimed shall be responsible for
the claimed horse until the post-race sample is collected. Any claimed horse not
otherwise selected for testing by the Stewards shall be tested if requested by the
Claimant at the time the claim form is submitted in accordance with these Rules. The
successful Claimant shall have the right to void the claim should the forensic analysis be                                                                                                                                positive for any prohibited substance, an illegal level of a permitted medication, or if a
blood sample exhibits a positive response to the erythropoietin (EPO) antibody test.
Rule 15.1.3.1.13 Erythropoietin (EPO) – A finding by the official chemist that the
antibody of erythropoietin (EPO) was present in a post-race test specimen of a horse
shall be promptly reported in writing to the Stewards. The Stewards shall notify the
Owner and Trainer of the positive test result for erythropoietin antibodies. The
Stewards shall notify the Commission Veterinarian of the name of the horse for
placement on the Veterinarian’s List, pursuant to Rule 5.32, if the positive test result
indicates that the horse is unfit to race. Any horse placed on the Veterinarian’s List
pursuant to this Rule shall not be permitted to enter a race until the Owner or Trainer,
at their own expense provides proof of a negative test result for EPO antibodies from a
laboratory approved by the Commission provided said test sample is obtained under
collection procedures acceptable to the Commission or its designee under these Rules.
Notwithstanding any inconsistent provision of these Rules, a horse shall not be subject
to disqualification from the race and from any share of the purse in the race and the
Trainer of the horse shall not be subject to application of the Trainer’s responsibility
based on the finding by the laboratory that the antibody of erythropoietin was present
in the sample taken from that horse.
Limitations on Claims:
A. No person shall claim more than one horse in a race.
B. No Authorized Agent, although representing more than one Owner, shall
submit more than one claim in any one race.
C. When a stable consist of horses owned by more than one person, trained by
the same Trainer, not more than one claim may be entered on behalf of such
stable in any one race.
D. An Owner who races in a partnership may claim in his or her individual
interest if the individual has started a horse in the partnership.
E. The individual must also have an account with the Horsemen’s Bookkeeper
that is separate from the partnership account.
Claim Irrevocable When Lodged – When a claim has been lodged with the Secretary, or
the Clerk of the Course, it is irrevocable, and is at the risk of the Claimant.
Collusive Claiming Punished:
A. Should the Stewards be of the opinion that any person is claiming a horse
collusively for the benefit of another interest or in order to evade the
provisions of any section of this Article, they may require him to make an
affidavit that he is not so doing, and if upon proof it be ascertained that he
makes a false affidavit, he shall be referred to the commission for further
action.

B. Should the Stewards within 24 hours after the running of a race be of the
opinion that the lease of the entry of a horse was not made in good faith but
made for the purpose of obtaining the privilege of entering a claim, then in
each case may disallow or cancel any such claim and order the return of a
horse that may have been delivered and refer the case to the Commission for
further action.
Stewards Certificate to Claim – An Owner whose stable has been eliminated by claiming
or fire or other hazards shall have the right to claiming during the remainder of the
meeting at which his stable was eliminated, or for the next thirty (30 days). If the thirty
(30) day period shall extend into the next succeeding meeting of the Racing Association,
the Owner must obtain a certificate from the Stewards of the meeting at which he lost
his last horse, and must present the certificate when filing a claim at the next meeting.
Thirty Day Prohibition – Sale of Claimed Horse – No horse claimed in a claiming race
shall be sold or transferred, wholly or in part, to anyone within thirty (30) days after the
day it was claimed, except in another claiming race.
CLAIMING RACES. TRANSFER OF CLAIMED HORSE RECORDS
(a) Entry of Horses subject to being claimed in a Claiming Race implies Owner (Trainer as
the agent of the Owner) consent for transfer of all Trainer and veterinary examination
and treatment records for the last sixty (60) days to the new Trainer of the claimed
Horse.
(b) If a Horse is successfully claimed by a new Trainer, the previous Trainer must transfer
Trainer records and authorize transfer of veterinary records to the new Trainer within
three (3) days of transfer of the Horse to the new Trainer.
VOID CLAIM
(a) Title to a Horse which is claimed shall be vested in the successful claimant from the
time the field has been dispatched from the starting gate and the Horse becomes a
starter.
(b) All claimed Horses shall go to the test barn for observation by the Regulatory
Veterinarian.
(c) The claim shall be voided, and ownership of the Horse retained by the original Owner
if:
(1) the Horse dies on the racing track;
(2) the Horse is euthanized before leaving the racing track;
(3) the Horse is vanned off of the racing track by discretion of the Regulatory
Veterinarian;
(4) the Regulatory Veterinarian determines within one (1) hour of the race
that the Horse will be placed on the Veterinarians’ List as Bled, physically
distressed, medically compromised, unsound, or lame before the Horse is
released to the successful claimant; or
(5) the Horse has a positive test for a Prohibited Substance.
(d) The claim shall not be voided if, prior to the Race in which the Horse is claimed, the
claimant elects to claim the Horse regardless of whether the Regulatory Veterinarian
determines the Horse will be placed on the Veterinarians’ List as Bled or unsound or the
Horse tests positive for a Prohibited Substance.

VETERINARY INSPECTIONS
(a) Veterinary inspections shall be performed by the Regulatory Veterinarians on all
Horses entered in a Race. Such inspections shall include the items listed in Rule 2142.
(b) If, prior to starting a Race, a Horse is determined to be unfit for competition, or if the
Regulatory Veterinarian is unable to decide of racing soundness, the Regulatory
Veterinarian shall notify the stewards that the Horse is scratched. Regulatory
Veterinarians shall have the unconditional authority to scratch a Covered Horse from a
Race.
ASSESSMENT OF RACING SOUNDNESS
(a) Post-entry screening. The Regulatory Veterinarian shall perform post-entry
screenings of previous pre-Race inspection findings of entered Horses to identify Horses
that may be at increased risk for injury. The Regulatory Veterinarian shall review past
performances, lay-ups (more than sixty (60) days without a timed Workout or Race), last
thirty (30) days medical history, previous injury and lameness diagnostics, intra-articular
corticosteroid injections, previous surgery, and individual Horse risk factors.
(b) Pre-race veterinary inspection. Every Horse entered to participate in a Covered
Horserace shall be subjected to inspection by a Regulatory Veterinarian prior to starting
in the Race for which it is entered on race day not later than one (1) hour prior to
scratch time for the Race in which the Horse is to compete.
(1) The Trainer of each Horse or a representative of the Trainer who is
knowledgeable about the Horse and able to communicate with the
Regulatory Veterinarian must present the Horse for inspection. Horses
presented for inspection must have bandages removed, and the legs must be
clean and dry. Prior to inspection, Horses may not be placed in ice and no
device or substance shall be applied to the Horse that impedes veterinary
clinical assessment.
(2) The Regulatory Veterinarian’s inspection of each Horse prior to
participating in a Race shall include, at a minimum, the following:
(i) Identification of the Horse.
(ii) Ascertainment of the sex of the Horse.
(iii) Performance of an overall inspection of the entire Horse,
assessing general appearance, behavior, disposition, posture, and
body condition.
(iv) Observation of the Horse jogging in hand, moving towards and
away from the Veterinarian so that both hind-end and front-end
motion can be evaluated.
(v) Performance of a digital palpation on both distal forelimbs.
(vi) Placement of the Horse on the Veterinarian’s List if the Horse
does not jog sound or warm up to the Regulatory Veterinarian’s
satisfaction
(vii) Visual observation in the paddock and saddling area, during
the parade to post, and at the starting gate.
(viii) Any other inspection deemed necessary by the Regulatory
Veterinarian, including Jockey consultation for the Jockey’s
mount.
(3) A report summarizing the results of a pre-Race inspection under this
paragraph

(a) shall be submitted to the Authority on the day of the
inspection.

(c) Post-race assessment. Post-Race visual observations shall be performed by a
Regulatory Veterinarian on all Horses leaving the racetrack at the conclusion of every
Race.
(1) If a Horse is determined to have Bled or to be physically distressed,
medically compromised, injured, or unsound at any time before exiting the
racetrack or leaving the test barn, the Horse shall be placed on the
Veterinarians’ List and the Regulatory Veterinarian shall document post-race
inspection findings to the Authority.
(2) If a Horse is determined to have skin lacerations, swellings, or welts that
resulted from crop use, the stewards and Attending Veterinarian shall be
notified, and the information documented to the Authority.
(d) Training. Regulatory Veterinarians may observe Horses during training activities.
Horses deemed physically distressed, medically compromised, injured, or unsound may
be placed on the Veterinarians’ List and reported to the Authority.
VETERINARIANS’ LIST
(a) A Veterinarians’ List shall be maintained by the Authority of all Horses that are
determined to be ineligible to compete in a Covered Horserace in any jurisdiction until
released by a Regulatory Veterinarian.
(b) The following Horses shall be placed on the Veterinarian’s List until removed in
accordance with Rules 2241 and 2242:
(1) Horses affected by illness, physical distress, medical compromise,
unsoundness, injury, infirmity, heat exhaustion, positive test or overage,
administration of a medication invoking a mandatory stand down time,
administration of Shock Wave Therapy, positive Out of Competition test or
any other assessment or determination by Regulatory Veterinarians that
such Horse is unfit to race.
(2) Horses which have not started in more than 365 days; and

(3) Horses which have not made a start prior to January 1 of their 4-year-
old year.

(c) Trainers and Owners shall be notified in writing within twenty-four (24) hours that
their Horse has been placed on the Veterinarians’ List.
(d) Diagnostic testing may be required for any Horse placed on the Veterinarians’ List, at
the discretion of the Safety Director, Regulatory Veterinarian, or Association
Veterinarian.
DURATION OF STAY ON THE VETERINARIANS’ LIST
Horses placed on the Veterinarian’s List in accordance with Rule 2240 shall remain on
the Veterinarian’s List as follows:
(a) Horses placed on the Veterinarians’ List for unsoundness or Epistaxis shall remain on
the list for fourteen (14) days;
(b) Horses placed on the Veterinarians’ List multiple times for unsoundness within the
previous 365 days shall remain on the Veterinarians’ List for forty-five (45) days for the
2nd time, seventy-five (75) days for the 3rd time, and shall be barred from further racing
after the 4th time;
(c) Horses placed on the Veterinarians’ List multiple times for Epistaxis within the
previous 365 days shall remain on the Veterinarians’ List for thirty (30) days for the 2nd                                                                                                                                    time, one-hundred and eighty (180) days for the 3rd time, and shall be barred from
further racing after the 4th time;
(d) Horses placed on the Veterinarians’ List for illness shall remain on the list
for seven (7) days;
(e) Horses treated with Shock Wave Therapy shall be placed on the
Veterinarians’ List for 27 thirty (30) days; and
(f) If before, during, or after the workout for removal from the Veterinarians’
List, the Horse is deemed to be unsound or to have Bled, the stay on the
Veterinarians’ List shall be extended an additional fourteen (14) days and
further diagnostic testing may be required as determined by the Regulatory
Veterinarian. 2242.
REMOVAL OF HORSES FROM THE VETERINARIANS’ LIST
Regulatory Veterinarians may remove Horses from the Veterinarians’ List in accordance
with this Rule and shall document such removal to the Authority.
A Horse placed on the Veterinarian’s List as unsound or suffering from
Epistaxis may be removed from the Veterinarian’s List upon satisfaction of
paragraphs (1) through (3) below.
(1) A trainer must apply to the Regulatory Veterinarian for
permission to work the Horse for removal from Veterinarian’s List.
Upon receiving such approval, the Trainer and Attending
Veterinarian must observe the Horse jog and submit to the
Regulatory Veterinarian a cosigned statement that the Horse is fit
to perform a Workout.
(2) The Horse must perform a Workout under the supervision of
the Regulatory Veterinarian and demonstrate to the satisfaction
of the Regulatory Veterinarian that the Horse is sound to race.
(3) The Regulatory Veterinarian determines there is no evidence
or signs of Epistaxis, physical distress, medical compromise,
unsoundness, or lameness within one (1) hour after the Workout
conducted pursuant to paragraph (a)(2) above.
(b) A Horse placed on the Veterinarians’ List as physically distressed or
medically compromised may be removed from the Veterinarians’ List
provided sound health has been declared by the Attending Veterinarian or
demonstrated to the Regulatory Veterinarian and documented to the
Authority.
(c) In addition to the requirements set forth herein and any requirements of
the Protocol, if a Horse is placed on the Veterinarians’ List for a positive test
or overage of a primary substance invoking a mandatory stand down time, a
positive Out-of-Competition test, or any other veterinary administrative
withdrawal, the Horse shall be prohibited from entering a Race and may be                                                                                                                                                      released from the Veterinarians’ List only after also undergoing a post-
Workout inspection by the Regulatory Veterinarian.

Paddock Attire – Delaware Park requires all licensed personnel attending a horse in the
paddock area to be properly attired and to have a neat, clean appearance: Cut-offs,
tank-tops, halter-tops, ripped or torn clothing, sagging pants, backward ball caps,
sandals, flip-flops or any open toed shoe(s) are unacceptable. All Grooms are
encouraged to wear a collared shirt and khaki pants. If the attire worn, by licensed personnel,                                                                                                                                to the paddock is unacceptable, said person(s) will be asked to leave the
paddock area immediately and will not be allowed to return until properly attired. By
order of Delaware Park Management Owners, Trainers, Persons and their Employees
are not allowed in the paddock area, unless they have a horse in such race.
Paddock Schooling – The Paddock will be open for schooling in the morning only on
Tuesdays and Fridays by appointment only. For race day schooling please contact the
paddock judge to make proper arrangements.
Post Parade Attire – All pony people escorting horses to the post must wear the
required attire. Proper attire will be strictly enforced by the Outriders. Proper attire
includes the following: White Helmet Cover, White Shirt, Hunter Green Protective Vest,
Tan or Khaki Pants, Green Saddle Towels, Delaware Park Issued Jackets (If needed).
Quick Official – In order to accelerate in making races official, when no interference has
been suspected or occurred or any other reason that may necessitate a delay in making
the race official, the following procedure will be followed: Registration of a claim of
foul. All Outriders shall be equipped with a two-way radio for communication with the
Stewards. Jockeys wishing to claim a foul or put a race on hold will so communicate
their wishes to the Outrider. If his horse is pulled up prior to reaching the Outrider, the
Jockey must proceed to the Outrider if he wishes to request a claim of foul or put the
race on hold. For those horses that pass the Outrider before they are pulled up, the
Outrider must wait until they pass him to unsaddle before communicating a no-claim
status to the Stewards. Obviously, if a fall occurs, the Stewards will demand an inquiry.
If for any reason the Outrider is unable to communicate to the Stewards, there will be
no Official for that race until all Jockeys have weighed in. It is understood that the
outrider’s number one priority is to catch a loose horse and this responsibility takes
precedence over the “Quick Official”. To permit an Owner or Trainer to request a claim
of foul or to put a race on hold, telephones are available at the following locations:
Winners Circle, Paddock Security Office, Racing Secretary’s Office and the Dining Room
Maître d’s desk. Or they can tell the Clerk of Scales to communicate their wishes of a
claim of foul, or to put the race in question on hold to the Stewards. Jockeys will
continue to weigh in after the race in the same fashion as is customary. The Jockeys
who have registered a foul will immediately contact the Stewards upon dismounting. At
any time, the outrider is not confident regarding the decision to permit a “Quick
Official” he will request the race to be put on hold.
Shavings Restriction – Shavings stalls will be disbursed on a limited basis. Please inquire
with the Stall Superintendent. Trainers in violation of shavings policy will be subject to
Fines.
Stakes – A fully paid entry in a stakes race, when denied the opportunity of drawing a
post position at the time of the official draw; will be entitled to a refund of nomination
and/or entry box fee. In all Handicap stakes and overnights, preference will be given to
high weights (scale considered). In Allowance stakes preference will be given to horses
that have accumulated the highest total earnings in 2022-2023, unless otherwise noted
in specifics of race. Delaware Park LLC retains the right to postpone or reschedule any
stakes race.

Stall Office – The Stall Office will be open on live race days. Make sure that you plan for
your horse’s arrival to avoid being delayed at the gate. All work order blanks must be
turned into the Main Gate and be filled out in detail with a contact person.

Starter Allowance races – Starter races will be treated as an Allowance race in eligibility
and determining allowances. In any Starter Handicap and/or Starter Stakes where any
part of the nomination, entry or start fees are included in the purse shall be considered
a Stakes race.
Starters Fee – All starters will pay a $20.00 fee in lieu of any pony fees. These fees paid
to the Association shall be for the account of the Delaware Horsemen’s Assistance Fund,
to be used exclusively by it to assist needy persons connected with Delaware Racing.
Transfers – After horses have been registered with the Racing Secretary listing their
Owners, no horse will be transferred, (unless claimed during a meeting) without
permission of the Stewards, who will require a notarized bill of sale from the registered
Owner. For a Trainer transfer, both the former and the current Trainer must contact
the Stewards for approval.
